It contains very important information about your rights and obligations, as well as limitations and exclusions that may apply to you. By purchasing an activity or tour package through mantis platforms, you are consenting to be bound by these terms and conditions and you represent and warrant that these terms and conditions are valid and binding on you.     We act only as an intermediary agent with only the role of a mediator. Even if you make a booking through us, the contract will be between the Supplier and you and the general travel and contractual terms and conditions of the Supplier shall apply. We are not a party to the contractual relationship.   The pictures of the activities and tour packages as shown on the website are indicative and may not be representative of the actual products.   The rates/prices of the activities and tour packages shown on the Site are just quotations and no blocking has been made. Prices/Taxes are subject to changes and availability.   Booking of activities or tour packages is subject to availability and confirmation of the activity or tour package Supplier. In the event that there is no availability on your selected date, you will have an option of either selecting an alternate date or obtaining a full refund within 5 working days.   In case we are not able to provide the hotel accommodation as shown on the website, we reserve the right to give the substitute hotel accommodation of the same standard. Hotel accommodation for a tour package will be provided on twin-sharing basis (2 persons sharing a room) unless otherwise specified in the activity or tour package itinerary / inclusions. Transportation for a tour package shall be provided as per the itinerary and will not be at disposal unless otherwise specified in the activity or tour package itinerary / inclusions.   Early check-in in case of tour package is not guaranteed and is subject to availability. The activity or tour package price does not include: expenses of personal nature, such as laundry, telephone calls, room service, alcoholic beverages, mini bar charges, tips, portage, camera fees etc. or any meals and services not specifically mentioned in the activity or tour package inclusions.   You agree that the terms of the activity or tour package may be subject to change at short notices due to circumstances beyond our or the Supplier’s control including but not limited to: Force Majeure events, strikes, fairs, festivals, weather conditions, traffic problems, closure of / entry restrictions at a place of visit, etc. While We and the Supplier will do our best to make suitable alternate arrangements, We would not be held liable for any refunds/compensation claims arising out of this.   It is mandatory for all guests to carry valid photo ID's (Passport/Driving License/Voter ID Card). PAN Card is not accepted at many places as a valid photo ID.   You agree that for all activity or tour packages where Bus / Car travel is involved, We are not responsible for:   ·         Bus / Car / Car not departing or reaching on time ·         The arrival and departure time on the ticket which is tentative. However, Bus / Car will not leave the source before scheduled departure ·         The Bus / Cardriver's employees being rude ·         Bus / Car seats etc. not being up to expectation of the customer ·         Stolen/ lost/ damaged baggage during the journey ·         Bus / Cardriver changing allotted seat at the last moment to accommodate a lady/child ·         Customer waiting at the wrong boarding point or getting delayed in reaching the boarding point ·         Bus / Cardriver changing the boarding point and/or using a pickup vehicle at the boarding point to take customer to the Bus / Car departure point ·         The Bus / Cardriver cancelling the trip due to unavoidable reasons. While We will do our best to make suitable alternate arrangements, We would not be held liable for any refunds/compensation claims arising out of this.   By making a booking through our website you make an offer to purchase the activity or tour package from the Supplier. We are authorized by each Supplier to accept your offer on its behalf; this acceptance occurs when we send you a written confirmation of the booking and payment as per payment policy is received. Before placing an order you are advised to check the description of the activity or tour package carefully. By making a booking for an activity or tour package you agree to be bound by the conditions of booking included in the activity or tour package's description. Once we accept your booking on behalf of our Supplier’s, a legally binding contract is formed between you and the Supplier of the activity or tour package chosen by you. The Supplier's general travel and contractual terms and conditions are made available by us to you by means of a link or full text before the booking takes place and they will apply in addition to those set out here. The Supplier's terms and conditions may include provisions relating to payment procedures, default, liability, cancellations, changes of bookings and refunds (if available) and any other restrictions.   Both Parties hereby represent and warrant to the other Party as follows: (a) It is duly incorporated/registered and validly existing under the applicable law of the jurisdiction in which it is incorporated/registered; (b) it has full power, capacity and authority to execute, deliver and perform this Agreement and has taken all necessary action (corporate, statutory, contractual or otherwise) to authorize the execution, delivery and performance of this Agreement; (c) the execution of this Agreement does not violate any statute, regulation, rule, order, decree, injunction or other restriction of any governmental entity, court or tribunal to which it is subject or any of the provisions of its charter documents, if applicable, that would materially adversely affect its ability to consummate the transactions contemplated herein; and (d) It has not suppressed any fact, which, if disclosed, might have affected the decision of the other Party to execute this Agreement. By offering travel related services to particular destinations, we do not represent or warrant that travel to such destinations is without risk, and shall not be liable for damages or losses that may result from travel to such destinations. The Supplier’s providing their activities and tour packages through us are independent contractors and not our agents or our employees. We are not liable for their acts, errors, omissions, representations, warranties, breaches or negligence or for any personal injuries, death, property damage or other damages or expenses resulting therefrom. We have no liability and we will make no refund in the event of any delay, cancellation, overbooking, strike or other causes beyond their direct control, and they have no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority. We shall not be liable for any indirect, punitive, special, incidental or consequential damages arising out of these Terms and Conditions (including, without limitation, loss of business, revenue, profits, goodwill, use, data or other economic advantage) however they arise, whether in breach of contract, breach of warranty, or in tort, including negligence, and even if we had previously been advised of, or could reasonably have foreseen, the possibility of such damages. The time of receipt by us of the declaration of cancellation shall be decisive for the time of withdrawal and cancellation fees to be applied by the Supplier. The laws of India govern the Activities and Tour Packages.
